Terms of Service

These Terms govern access to and use of Menu Marketplace websites, online-ordering tools, customer accounts, and related services. By using the services, you agree to these Terms and our Privacy Policy.

Marketplace role

Menu Marketplace provides technology that helps customers discover and order from participating businesses. Participating businesses are responsible for their menus, products, pricing, availability, preparation, fulfillment, taxes, required licenses, and compliance with applicable law.

Accounts

You are responsible for accurate account information, safeguarding credentials, and activity under your account. Business access is permission-controlled and separate from customer access. We may suspend access when reasonably necessary to protect users, businesses, the platform, or the public.

Orders and payments

Orders are subject to acceptance, product availability, business hours, delivery availability, and successful payment authorization. Prices, taxes, tips, fees, discounts, and fulfillment details are presented before an order is submitted. Refunds and cancellations are governed by the applicable business policy and payment status, subject to law.

Pickup and delivery

Quoted preparation and delivery times are estimates. Delays may occur because of demand, traffic, weather, inventory, staffing, third-party services, or other circumstances. Customers are responsible for accurate contact and delivery information and safe, lawful receipt of orders.

SMS communications

Transactional text messages are optional and require separate consent where offered. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. Additional details appear in our SMS Terms.

Acceptable use

You may not misuse the services, interfere with their operation, attempt unauthorized access, submit fraudulent orders, violate others' rights, or use the platform for illegal, harmful, or deceptive activity.

Availability and changes

Services may change and may occasionally be unavailable. We may update features, security controls, participating businesses, or these Terms. Material changes will be posted with a revised effective date.

Disclaimers and limitation

To the extent permitted by law, services are provided on an “as available” basis. Menu Marketplace does not guarantee uninterrupted availability or the acts, products, or services of independent participating businesses and delivery providers. Liability is limited to the extent permitted by applicable law; nothing in these Terms excludes rights that cannot legally be excluded.
